Creating a Disclaimer Rule*

Navigate to Rules in Red Marker. Hover over ‘Create Your Own Rule’ in the top right-hand corner. Click on “Disclaimer”.

*Please note this functionality can also be used to create rules for disclosures.

Firstly, decide on a particular disclaimer on which you want to focus. For example, you may want to make sure that any marketing collateral for credit cards has the appropriate disclaimer. This means that whenever these terms are mentioned in a document:

MyBank credit cards
MyBank low rate cards

I want to make sure that at least one of these approved disclaimers are mentioned:

Populate the respective lists in the rule creation page with this information as so:

Then set the rule live using the toggle in the top right-hand corner once the rule has a name and description, and both the phrase list and disclaimer lists have at least one entry each:

The rule will tell you:

  1. If no attempted disclaimer were found in the document when one is required and provide an example of an approved disclaimer to add to the document, or

  2. The added and missing text between the attempted disclaimer/s in the document and the most similar approved disclaimer to each, or

  3. For each attempted and more similar approved disclaimer pair with lots of differences between the two, where the attempted disclaimer is and what the most similar approved disclaimer is. In this case, it is suggested that the approved disclaimer is copied and pasted into where the attempted disclaimer is in the document.

You're now ready to upload a document to test out your disclaimer rule!

Testing and Updating the Rule:

You can try out your rule by running a review the usual way. If the rule does not return any annotations on a document where you were expecting it to, this means some more terms need to be added to the phrase list. If the rule says no attempted disclaimers were found but there is, in fact, a relevant disclaimer in the document, make sure it is correct, then add it to the disclaimer list. If the rule returns some attempted disclaimers which are approved, add these to the disclaimer list. The rule will consider any change in future reviews.

Things to note:

  • Any chunk of text which is at least 60% similar to an approved disclaimer will be returned as an attempted disclaimer. Therefore, there is a small chance that some document content is misidentified as an attempted disclaimer. Similarly, some attempted disclaimer identified may not include all of the disclaimer in the document if the numbers of sentences in the attempted and approved disclaimer are not equal.

  • The method we use to find attempted disclaimers is powerful but may take some time, especially when there are lots of approved disclaimers to check for. We suggest you minimize the number of approved disclaimer variations as much as possible - this also makes it easier for your marketing team to keep track of all of them!

  • Both the phrase and disclaimer lists are case insensitive by default; if you type in "MyBank credit cards" as a term that must be mentioned, then "MyBank Credit Cards" will be picked up when searching a document.

  • For a bulk upload of terms into the phrase list, make sure each term is on a separate line before

  • For a bulk upload of terms into the phrase list, copy and paste your terms into the textbox, making sure each is on a separate line. Click the + button or press your return/enter key and each line will be converted into a separate entry in the list. Bulk upload is not available for the disclaimer list as disclaimers may have content on separate lines.

  • If a disclaimer involves a date or number, simply add in an example date or number, e.g. ‘11-03-2020’, ‘2020/05/03’, ‘500’, '0.3'. Do not use an example date like 0000-00-00 or 99-99-9999. If the only differences between the attempted and the approved disclaimer are dates and/or numbers, then the attempted disclaimer will be deemed not risky. If there are date/number and text differences, then the attempted disclaimer will be flagged and all differences shown if there aren't too many. Dates in the form of "29th Dec 2020" will not be considered as a variable in the above way, instead, an exact match between the attempted and approved disclaimer will be performed on this type of text.

  • If you are copying your disclaimers from somewhere and adding them to the rule, make sure all symbols, like the trademark symbol, have copied over correctly.
